LA Fitness Sued for Billing Fraud

A lawsuit has been filed in Maricopa County Superior Court against LA Fitness.   College student Benjamin Calleros claims he was defrauded of more than $1,200 for services he didn’t sign up for. 

According to the Arizona Republic, Calleros was offered a free training assessment shortly after purchasing a gym membership at an LA Fitness located in Tempe, Arizona. After completing the assessment, the personal trainer asked Calleros to sign up for personal training sessions. Calleros declined and the personal trainer asked Calleros to sign a waiver on a small hand-held electronic-signature pad.   Calleros signed the electronic device, believing that he was signing a waiver. Calleros contends that his signature was later pasted on a personal training contract that allowed LA Fitness to electronically deduct payments from his account. Calleros’ attorney told the Republic that the suit raised even larger questions about the way electronic signatures’ are collected via remote devices.

LA Fitness is a member of the International Health, Racquet & Sports Club Association, who when contacted, did not comment specifically on the lawsuit, but noted that as a member of the association, LA Fitness must abide by a code-of-conduct that prohibits “illegal activities and deceptive sales practices.” LA Fitness is also obligated to conduct business “in a manner that commands the respect of the public for our industry.”
