Class Action Lawsuit Against LA Fitness Alleges Deceptive Monthly Billing Practices
Former fitness club members of LA Fitness have filed a class action lawsuit against the company for improper billing practices, claiming the company violated its monthly dues contract by improperly charging club members monthly dues after they had cancelled their memberships.
According to the complaint, the lead plaintiff sent LA Fitness a written request to terminate her membership but the company continued to bill her for another fourteen (14) months of membership services and later refused to return the fees.
In 2011, two other class action lawsuits were filed against LA Fitness over alleged deceptive billing practices and a settlement was reached last year over allegations the company improperly charged fees to members who decided to cancel their personal training contracts early.
Plaintiff is now suing LA Fitness asserting breach of contract, unjust enrichment and damages, and is seeking an injunction from the court to stop LA Fitness from continuing to improperly charge club members monthly fees after cancellation. The case has been filed in the United States District Court for the Eastern District of Texas on behalf of all consumers who incurred at least one additional monthly billing charge after timely cancelling their monthly membership agreements.
