Nationwide Fraud Class Action Filed Against Technical Support Company MyTechHelp

Consumer, Kelly Guerra, has filed a class action in the Missouri Federal Court against MyTechHelp, LLC, alleging that the company engages in fraud by representing to consumers that it is affiliated with the manufacturers of several electronic devices, when in fact it is not, and offering technical support services the company is not qualified to offer. Ms. Guerra further alleges that MyTechHelp engages in fraudulent billing practices by charging unauthorized recurrent monthly charges to consumers’ debit/credit card accounts.

Ms. Guerra contacted MyTechHelp to locate her lost iPhone, believing that she was contacting Apple’s technical support department. During the telephone conversation with the MyTechHelp representative, Ms. Guerra agreed to pay $69.99 to have the company locate her lost phone. However, according to Ms. Guerra, at no time did the MyTechHelp representative identify that he did not work for Apple and that the company he worked for was in no way affiliated with Apple. Instead, the complaint alleges that MyTechHelp representatives claim to be affiliated with the manufacturers of several electronic devices, claim that the issues and devices consumers call about are not covered by the product warranty, and request consumers’ debit or credit card information to complete the requested service.

The complaint alleges that after the MyTechHelp telephone representatives obtain consumers’ debit/credit card information, the company charges unauthorized monthly charges to consumers’ accounts. According to the complaint, the MyTechHelp representative signed Ms. Guerra up for a “tech support plan” at $19.99 per month, which he had not disclosed to her and which she had not requested, and then proceeded to debit her account on a monthly basis without Ms. Guerra’s knowledge.

The class action lawsuit has been brought on behalf of all United States residents who were subject to unauthorized debit/credit card charges by MyTechHelp. The complaint alleges causes of action for unjust enrichment, deceptive trade practices, consumer fraud, violations of the Missouri Merchandising Practices Act, and violations of the Electronic Funds Transfer Act, seeking an injunction and fraud damages on behalf of the class.
