Los Angeles Consumer Files Class Action Alleging False Advertising of Aveda Hair Loss Products

A Los Angeles consumer, Rivkie Berger, filed a class action lawsuit in California Federal Court, alleging that the hair product manufacturer, Aveda Corporation, has engaged in deceptive and false advertising of its Invati hair thickening products. The complaint alleges that the Invati product line’s advertisements make false promises and that the products do not help to reduce hair loss.

The lawsuit alleges that consumers purchased the Invati products based upon product labels claiming they are “solutions for thinning hair,” and advertising promising that the products “reduce hair loss by 33%” and are “clinically proven to reduce hair loss due to breakage,” but that these claims are false. Ms. Berger claims that she purchased “Invati System,” which consists of an “Exfoliating Shampoo,” a “Thickening Conditioner,” and a “Scalp Revitalizer,” for $119.63, including tax, and that she did not experience any of the benefits promised after using the products. By making these allegedly false representations, Ms. Berger claims Aveda has been able to charge a premium to consumers, who would not have purchased the products but for Aveda’s deceptive advertising.

Ms. Berger is suing on behalf of a class of all United States consumers who purchased any Invati products at any time between July 16, 2009 and the resolution of the lawsuit, and has alleged violations of the California Consumer Legal Remedies Act, California False Advertising Law, and California’s Unfair Competition Law. The complaint seeks an injunction prohibiting Aveda from advertising the Invati products as effective at reducing hair loss in addition to restitution and disgorgement of all profits Aveda has acquired through its allegedly false advertising, among other forms of relief.
